Description

The “Beckham Law” or Special Expats’ Tax Regime (“SETR”), from Spanish Régimen Especial para Trabajadores Desplazados, provided for in Article 93 of Act 35/2006, of November 28, on Spanish Personal Income Tax, is intended for individuals who move to Spain to work and acquire the status of tax residents in Spain.

The regulations governing the SETR require that in order for it to be applicable, a series of requirements must be met. On the other hand, it should be noted the main objective of the SETR is to offer more favourable tax treatment to those taxpayers who apply it. This more favourable tax treatment translates into a series of special rules when determining the tax liability of the Spanish Personal Income Tax. However, these special rules do not always result in tax savings with respect to the standard tax treatment applicable if you do not apply for the SETR.
